5. User Content

5.1 Ownership

You retain ownership of any content you create, upload, or generate using our Services ("User Content"). By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of providing and improving our Services.

5.2 Content Responsibility

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:

You own or have the necessary rights to use and authorize us to use your User Content
Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
Your User Content complies with all applicable laws and regulations

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or inappropriate. We are not obligated to monitor User Content but may do so at our discretion.

6.2 Templates and Designs

Templates, designs, and other materials provided by Postographic are protected by copyright and other intellectual property laws. You may use these materials solely for creating content through our Service. You may not copy, modify, distribute, or create derivative works based on our templates or designs outside of our Service.

7. Payments and Subscriptions

7.1 Pricing

We offer both free and paid subscription plans. Pricing for paid plans is displayed on our website and may be updated from time to time. We reserve the right to change our pricing with reasonable notice.

7.2 Payment Terms

By purchasing a subscription, you agree to pay the fees specified at the time of purchase. Payments are processed through third-party payment processors. You are responsible for providing accurate payment information and authorizing charges.

7.3 Refunds

Refund policies are specified at the time of purchase. Generally, subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy. If you believe you are entitled to a refund, please contact us.

8. Credits and Usage

Our Service uses a credit system for certain features, particularly AI-powered content generation. Credits may be provided as part of a subscription, purchased separately, or earned through promotions. Credits are non-transferable and non-refundable, except as required by law.

We reserve the right to modify credit pricing, credit requirements for features, and credit expiration policies with reasonable notice.

9. AI-Generated Content

Our Services may use artificial intelligence to generate content. You acknowledge that:

AI-generated content may not always be accurate, appropriate, or suitable for your intended use
You are responsible for reviewing and editing AI-generated content before use
We do not guarantee the quality, accuracy, or suitability of AI-generated content
AI-generated content may be similar to content generated for other users

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of correctness, accuracy, reliability, or otherwise.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POSTOGRAPHIC, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for all claims arising from or related to the use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Postographic, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

Your use of and access to the Service
Your violation of any term of these Terms
Your violation of any third-party right, including without limitation any copyright, property, or privacy right
Any claim that your User Content caused damage to a third party

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through your account settings.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United States.
